United States: Federal Laws & Regulations

πŸ‡ΊπŸ‡Έ United States Federal Laws & Regulations for Assistance Animals are as follows:

Acceptance

Emotional Support Animals (ESA):Accepted with Conditions

Psychiatric Support Animals (PSA):Accepted Nationwide

Service Animals:Accepted Nationwide

Tip:Always carry your Physical ID Card and visible Recognition Gear. A Prescription Letter, Registration Certificate, and Behavior Certificate will significantly reduce access disputes across federally regulated environments.

Housing (Federal)

Housing-related acceptance of assistance animals in the United States is governed by the Fair Housing Act (FHA) and enforced by the U.S. Department of Housing and Urban Development (HUD). Service Animals and PSAs must be accommodated as reasonable accommodations. ESAs are also protected under the FHA when supported by a valid prescription letter. Breed, weight, and pet restrictions do not apply when accommodation criteria are met.

Air Travel (Federal)

Air travel within and to/from the United States is governed by the Air Carrier Access Act (ACAA) and enforced by the U.S. Department of Transportation (DOT). Service Animals and PSAs are permitted to fly in-cabin when DOT documentation and behavior standards are met. ESAs are no longer federally protected for air travel and are accepted with conditions depending on airline policy.

Tip:Our registry is approved by all airlines. Carrying your Physical ID Card and Recognition Gear helps streamline DOT form verification and gate-level approval.

Public Access (Federal)

Public access rights for assistance animals are governed by the Americans with Disabilities Act (ADA). Service Animals and PSAs trained to perform tasks are permitted in all public places, including restaurants, hotels, stores, transportation, hospitals, and government buildings. ESAs do not have federal public-access rights under the ADA.

Additional Notes

  • Service Animals & PSAs: protected nationwide under ADA, FHA, and ACAA.
  • ESAs: protected in housing under the FHA, but not in public access or air travel.
  • Businesses may ask only ADA-permitted questions regarding Service Animals.
  • Recognition Gear is not legally required but strongly recommended.
