Texas’s Laws & Regulations for Assistance Animals are as follows:

Acceptance

Emotional Support Animals (ESA):Accepted with Conditions

Psychiatric Support Animals (PSA):Accepted Nationwide

Service Animals:Accepted Nationwide

Tip:
Texas has major metropolitan cities and rural counties. Always keep your Physical ID Card and visible Recognition Gear. A Prescription Letter, Registration Certificate, and Behavior Certificate help reduce disputes, especially during police encounters or in small municipalities.

Housing

Texas landlords must follow the federal Fair Housing Act (FHA), which requires accommodations for ESAs, PSAs, and Service Animals when proper documentation is provided. Texas Property Code also prohibits disability-based discrimination in rental housing.

Air Travel

Texas follows the Air Carrier Access Act (ACAA). Only trained service dogs may fly as Service Animals. ESAs follow airline pet rules. Airlines may require DOT forms at Dallas–Fort Worth (DFW), Houston (IAH/HOU), Austin (AUS), San Antonio (SAT), and all regional airports.

Public Access

Texas complies with the Americans with Disabilities Act (ADA) and state law under Texas Human Resources Code § 121. Only trained Service Dogs—including psychiatric service dogs—must be granted access to restaurants, hotels, stores, transit systems, schools, and government buildings. ESAs do NOT have public-access rights.

Additional Notes

  • ADA: Only task-trained dogs qualify as Service Animals.
  • ACAA: Only trained Service Dogs are permitted for in-cabin flight.
  • FHA & Texas housing law: ESAs, PSAs, and Service Animals qualify for housing accommodations.
  • Misrepresentation penalties: Texas enforces fines for fraudulent Service Animal claims under § 121.006.
  • Recognition Gear: Highly recommended in rural counties and unincorporated areas.
