South Dakota’s Laws & Regulations for Assistance Animals are as follows:
Acceptance
Housing
South Dakota landlords must comply with the federal Fair Housing Act (FHA), which protects ESAs, PSAs, and Service Animals when proper documentation is provided. The South Dakota Human Relations Act also prohibits discrimination in housing based on disability.
Air Travel
South Dakota follows the Air Carrier Access Act (ACAA). Only trained service dogs may fly as Service Animals. ESAs must follow airline pet rules. DOT forms may be required at Sioux Falls (FSD), Rapid City (RAP), and regional airports.
Public Access
South Dakota follows the Americans with Disabilities Act (ADA) and state law under SDCL 20-13-23.2. Only trained Service Dogs—including psychiatric service dogs—must be allowed in restaurants, hotels, stores, medical buildings, public transit, and government facilities. ESAs do NOT have public-access rights.
