Nebraska: Laws & Regulations

Nebraska’s Laws & Regulations for Assistance Animals are as follows:

Acceptance

Emotional Support Animals (ESA):Accepted with Conditions

Psychiatric Support Animals (PSA):Accepted Nationwide

Service Animals:Accepted Nationwide

Tip:
Always carry your Physical ID Card and visible Recognition Gear. In Nebraska—especially in rural counties—having a Prescription Letter, Registration Certificate, and Behavior Certificate helps prevent delays.

Housing

Nebraska landlords must comply with the Fair Housing Act (FHA), which requires reasonable accommodation for ESAs, PSAs, and Service Animals. Nebraska also enforces the Nebraska Fair Housing Act to protect individuals with disabilities in rental situations.

Air Travel

Nebraska follows the Air Carrier Access Act (ACAA). Only trained service dogs qualify as Service Animals. ESAs must fly under airline pet policies. DOT forms may be required when flying from Omaha (OMA), Lincoln (LNK), or regional airports.

Tip:
Our registry is approved by all airlines — your Physical ID Card, Registration Certificate, and Recognition Gear ensure quick airline processing under ACAA rules.

Public Access

Nebraska public access follows the Americans with Disabilities Act (ADA) and Nebraska Revised Statutes § 20-127. Only trained Service Dogs—including psychiatric service dogs—must be allowed in stores, hotels, restaurants, hospitals, transit, and government buildings. ESAs do not qualify for public-access rights.

Additional Notes

  • ADA: Only task-trained dogs qualify as Service Animals.
  • ACAA: Only trained Service Dogs qualify for in-cabin air travel.
  • FHA & Nebraska Fair Housing Act: ESAs, PSAs, and Service Animals qualify for housing accommodations.
  • State penalties: Nebraska enforces fines for misrepresenting Service Animals.
  • Recognition Gear: Strongly recommended statewide.
