Montana’s Laws & Regulations for Assistance Animals are as follows:
Acceptance
Always carry your Physical ID Card and visible Recognition Gear. Montana businesses and rural facilities respond faster when you also carry a Prescription Letter, Registration Certificate, and Behavior Certificate.
Housing
Montana landlords must follow the Fair Housing Act (FHA), which requires them to accommodate ESAs, PSAs, and Service Animals with valid documentation. Montana additionally enforces disability protections through the Montana Human Rights Act.
Air Travel
Montana follows the Air Carrier Access Act (ACAA). Only trained service dogs may fly as Service Animals. ESAs must follow airline pet policies. DOT forms may be required at Bozeman (BZN), Missoula (MSO), Kalispell (FCA), Billings (BIL), and other airports.

Public Access
Montana follows the Americans with Disabilities Act (ADA) and Montana Code § 49-4-214. Only trained Service Dogs—including psychiatric service dogs—must be allowed in hotels, restaurants, retail stores, public transportation, hospitals, and government buildings. ESAs are not allowed public-access privileges under ADA or Montana law.

- ADA: Only trained task-performing dogs qualify as Service Animals.
- ACAA: Only trained Service Dogs are accepted for in-cabin flights.
- FHA & Montana Human Rights Act: ESAs, PSAs, and Service Animals qualify for housing accommodations.
