General Ownership & Control

Leash & Muzzle Rules

  • Virginia has no statewide leash law, but nearly all counties/cities require dogs to be leashed in public.
    • Fairfax County, Arlington, Richmond, Virginia Beach, Norfolk, and Roanoke mandate leashes (typically ≤6 ft).
  • Under VA Code §3.2-6538, dogs may not “run at large.”
  • Muzzles are not required for general dogs.
  • Dogs officially classified as “dangerous” or “vicious” under VA Code §3.2-6540 must be:
    • Muzzled in public
    • Restrained with a strong leash
    • Confined in a secure enclosure at home
    • Registered in the Virginia Dangerous Dog Registry

Breed-Specific Bans/Restrictions

  • Virginia has no statewide breed bans.
  • Municipalities can regulate dangerous dogs, but they cannot ban breeds outright.
  • Housing/HOA restrictions may exist privately but not legally by government.

Licensing & Microchipping

  • All dogs ≥4 months old must be licensed annually with the county/city (VA Code §3.2-6528).
  • Rabies vaccination proof must be provided to obtain a license.
  • Microchipping is not mandatory statewide, but nearly all shelters implant one prior to adoption.

Service Dogs & Assistance Animals

Legal Definitions

Under the ADA and Virginia Human Rights Act (VA Code §2.2-3904), a service dog is a dog trained to perform specific disability-mitigating tasks, such as:

  • Guiding visually-impaired individuals
  • Alerting deaf/hard-of-hearing handlers
  • Mobility or balance support
  • Psychiatric task support (interruption, grounding, alerts)

Public Access Rights

  • Service dogs may access restaurants, hotels, transit, workplaces, retail stores, schools, government buildings, and all public spaces under ADA and VA Code §51.5-44.
  • Denial of access is a civil rights violation.

Certification/ID Requirements

  • Virginia does not require registration or ID for service dogs.
  • Only the two ADA questions may be asked.
  • Misrepresenting a dog as a service animal is illegal under VA Code §51.5-44.1, punishable by fines up to $250.

Emotional Support Animals (ESA) & Psychiatric Service Animals (PSA)

Legal Recognition

Emotional Support Animals (ESAs) and Psychiatric Service Animals (PSAs) are only recognised in Virginia when registered with an accredited organisation that verifies their legitimacy and purpose.

Housing Rights

  • Registered ESAs/PSAs are protected under the Fair Housing Act (FHA) and VA Fair Housing Law (VA Code §36-96.3).
  • Landlords must provide reasonable accommodations, even in no-pet housing, when proper registration/documentation is provided.

Travel Rights

  • Airlines: Only trained and registered psychiatric service dogs qualify under DOT service-animal regulations.
  • ESAs follow airline pet policies.
  • Public transit: Service dogs always accepted; ESAs/PSAs may be accepted case-by-case.

Veterinary & Animal Welfare Standards

Vaccination Schedules

  • Rabies vaccination is required for all dogs ≥4 months under VA Code §3.2-6521.
  • Proof must be available for inspection and licensing.
  • Recommended vaccines: DHPP (distemper, hepatitis, parvo, parainfluenza).

Neutering/Spaying Regulations

  • Not required statewide.
  • Shelters commonly require sterilization before adoption.

Animal Welfare Acts

Under VA Code §3.2-6500–6581, owners must:

  • Provide adequate food, water, shelter, and vet care
  • Protect dogs from extreme weather
  • Not leave animals in hot/cold cars (VA Code §3.2-6570(F))
  • Avoid abuse, neglect, or abandonment

Penalties range from misdemeanors to felonies.
