General Ownership & Control

Leash & Muzzle Rules

  • Montana has no statewide leash law, but most cities and counties have their own leash and restraint ordinances.
    • Billings, Bozeman, and Missoula require dogs to be on a leash or under voice control in public areas (Billings City Code §4-406; Bozeman Code §7.04.030).
  • Dogs found “at large” can be impounded by animal control.
  • Muzzles are not generally required unless the dog is declared “dangerous” under the Montana Dangerous Dog Law (MCA §7-23-2109).
  • Dangerous dogs must be muzzled, leashed, and confined when outside the owner’s property.

Breed-Specific Bans/Restrictions

  • Montana has no statewide or local breed bans.
  • State law does not permit municipalities to create breed-specific legislation, meaning no breed (including pit bulls) is restricted.

Licensing & Microchipping

  • Dogs over 6 months old must be licensed annually with their local municipality or county (MCA §7-23-2105).
  • Proof of current rabies vaccination is required.
  • Microchipping is not mandated statewide but recommended for identification and may be required for shelter adoptions.

Service Dogs & Assistance Animals

Legal Definitions

Under the Americans with Disabilities Act (ADA) and Montana Human Rights Act (MCA §49-4-214), a service dog is defined as a dog trained to perform specific tasks for a person with a disability.
Examples include:

  • Guide dogs for individuals with visual impairments.
  • Hearing dogs for the deaf or hard of hearing.
  • Mobility and psychiatric service dogs trained to assist with balance, alerts, retrieval, or calming behaviors.

Public Access Rights

  • Service dogs are granted full and equal access rights to all public spaces, including restaurants, shops, workplaces, housing, and transport, under MCA §49-4-214.
  • Denying access or charging extra fees for service dogs is illegal under both state and federal law.

Certification/ID Requirements

  • Montana does not require service dogs to be certified or registered.
  • Staff may only ask:
    1. Whether the dog is required due to a disability.
    2. What task the dog performs.
  • Falsely identifying a pet as a service dog is a misdemeanor under MCA §49-4-214(5), with fines up to $1,000.

Emotional Support Animals (ESA) & Psychiatric Service Animals (PSA)

Legal Recognition

Emotional Support Animals (ESAs) and Psychiatric Service Animals (PSAs) are only recognised in Montana when registered with an accredited organisation that verifies their role and necessity.

Housing Rights

  • Registered ESAs and PSAs are protected under the Fair Housing Act (FHA) and Montana Human Rights Act (MCA §49-2-304).
  • Landlords must make reasonable accommodations for registered ESAs/PSAs even in “no-pet” housing, provided valid registration or documentation is presented.

Travel Rights

  • Airlines: Only psychiatric service dogs (registered and trained) are recognised for in-cabin travel under DOT regulations.
  • ESAs are treated as pets for air travel but may still travel in-cabin if permitted by airline policy.
  • Public transport (buses, trains, ferries): Service dogs are always allowed; registered ESAs/PSAs may be accepted if calm, leashed, and under control.

Veterinary & Animal Welfare Standards

Vaccination Schedules

  • Rabies vaccination is mandatory for all dogs over 3 months old (MCA §7-23-2106).
  • Proof of vaccination must be presented during licensing and upon request by animal control.
  • Other recommended vaccines include distemper, parvovirus, and adenovirus.

Neutering/Spaying Regulations

  • Not required statewide, but shelters must spay or neuter all adopted dogs prior to release.

Animal Welfare Acts

Under MCA §45-8-211, animal cruelty laws require that owners:

  • Provide adequate food, water, shelter, and medical care.
  • Protect dogs from neglect, abuse, and unsafe conditions.
  • Avoid confining pets in vehicles during extreme heat or cold.

Violations can lead to fines, criminal charges, and removal of the animal.
