California’s Laws & Regulations for Assistance Animals are as follows:

Acceptance

Emotional Support Animals (ESA):Accepted with Conditions

Service Animals:Accepted Nationwide

Tip:Always carry your Physical ID Card and visible Recognition Gear. A Prescription Letter, Registration Certificate, and Behavior Certificate will greatly facilitate smooth acceptance across California’s airports, hotels, rental properties, and public venues.

Housing

California follows the federal Fair Housing Act (FHA), but the state also has strong disability protection laws under the California Fair Employment and Housing Act (FEHA). Both laws require housing providers to allow assistance animals—including ESAs, PSAs, and Service Animals—when supported by proper documentation. California landlords may request verification when the disability or need is not apparent, but cannot charge pet fees for assistance animals.

Air Travel

All flights to or from California follow the Air Carrier Access Act (ACAA). Only trained service dogs qualify as Service Animals for in-cabin travel. ESAs are transported as pets according to airline policy. DOT Service Animal forms may be required at LAX, SFO, SAN, SMF, OAK, and other airports. Because California has many major international airports, advanced airline documentation is strongly recommended.

Public Access

California aligns with the Americans with Disabilities Act (ADA), and state law (California Civil Code § 54.1) reinforces these protections. Only trained Service Dogs (including psychiatric service dogs) have guaranteed public-access rights. They must be permitted inside restaurants, hotels, hospitals, public transportation, stores, and government buildings. ESAs are not Service Animals under ADA or California state law and do not have automatic public-access rights.

  • ADA (public access): Service Animals must be trained to perform disability-related tasks; ESAs providing comfort only do not qualify.
  • ACAA (air travel): Airlines recognize only trained Service Dogs as Service Animals under federal regulations.
  • FHA & FEHA (housing): California offers strong legal protections requiring landlords to allow ESAs, PSAs, and Service Animals with proper documentation.
  • California penalties: Misrepresenting a pet as a Service Animal can result in fines under state law.
  • Recognition Gear: Strongly recommended to reduce disputes and improve understanding in public areas.
