Colorado’s Laws & Regulations for Assistance Animals are as follows:

Acceptance

Housing

Colorado housing providers must comply with the federal Fair Housing Act (FHA), which requires reasonable accommodations for assistance animals—including ESAs, PSAs, and Service Animals—when properly documented. Colorado also enforces state-level protections under the Colorado Anti-Discrimination Act (CADA), providing strong rights for individuals with disabilities in rental housing.

Air Travel

All flights to or from Colorado fall under the Air Carrier Access Act (ACAA). Only trained service dogs qualify as Service Animals for airline travel. ESAs and comfort animals are transported under the airline’s pet policy. Service Dog DOT forms may be required at major airports including Denver International (DEN), Colorado Springs (COS), and regional mountain airports.

Public Access

Colorado public access aligns with the Americans with Disabilities Act (ADA). Only trained Service Dogs (including psychiatric service dogs) have guaranteed access to restaurants, hotels, public transportation, medical facilities, stores, schools, and government buildings. ESAs are not recognized as Service Animals and do not have public-access rights under ADA or state law.

Additional Notes

  • ADA (public access): Only dogs trained to perform disability-related tasks qualify as Service Animals. ESAs do not fall under ADA protections.
  • ACAA (air travel): Airlines must allow trained Service Dogs; ESAs are classified as pets for air travel.
  • FHA & CADA (housing): ESAs, PSAs, and Service Animals may all qualify as assistance animals in Colorado housing.
  • State penalties: Colorado has penalties for misrepresenting a pet as a Service Animal under C.R.S. § 18-13-107.3.
  • Recognition Gear: Strongly recommended for smoother interactions in populated and rural regions.

Applicable Laws

Emotional Support Animals (ESA):

Psychiatric Support Animals (PSA):
PSAs qualify as Service Animals only when task-trained; otherwise treated as ESAs.
