General Ownership & Control
Leash & Muzzle Rules
- Wisconsin does not have a statewide leash law, but every major city and county requires dogs to be restrained or leashed in public:
- Milwaukee, Madison, Green Bay, Kenosha, Eau Claire, and Waukesha enforce leash laws (typically ≤6 feet).
- Under Wisconsin Statutes §174.02, owners are strictly liable for injuries or damage caused by a dog running at large.
- Muzzles are not required for standard dogs.
- Dogs designated as “dangerous” under §174.02(3) must be:
- Muzzled in public
- Restrained on a strong leash
- Confined securely while on private property
Breed-Specific Bans/Restrictions
- Wisconsin has no statewide breed bans.
- Some municipalities may impose additional rules, but breed-specific bans are discouraged and uncommon.
- No major Wisconsin city bans pit bull–type breeds.
Licensing & Microchipping
- All dogs ≥5 months old must be licensed annually under §174.05.
- Licensing requires proof of current rabies vaccination.
- Microchipping is not required statewide but is highly recommended and is mandatory for shelter adoptions in many counties.
Service Dogs & Assistance Animals
Legal Definitions
Under the ADA and Wisconsin Statutes §106.52, a service dog is a dog trained to perform specific tasks for an individual with a disability, including:
- Guiding visually impaired individuals
- Alerting deaf/hard-of-hearing handlers
- Providing mobility assistance
- Performing psychiatric service tasks (interrupting, grounding, alerts)
Public Access Rights
- Service dogs must be permitted in restaurants, housing, public transportation, workplaces, hotels, schools, and retail shops, per ADA and §106.52(3).
- Denying access is unlawful discrimination.
Certification/ID Requirements
- Wisconsin does not require certification or identification for service dogs.
- Only the two ADA-permitted questions may be asked.
- Misrepresentation of a service animal is illegal under §106.52(3)(am), punishable by fines up to $500.
Emotional Support Animals (ESA) & Psychiatric Service Animals (PSA)
Legal Recognition
Emotional Support Animals (ESAs) and Psychiatric Service Animals (PSAs) are only recognised in Wisconsin when registered with an accredited organisation that verifies their purpose and legitimacy.
Housing Rights
- Registered ESAs/PSAs are protected by the Fair Housing Act (FHA) and Wisconsin Open Housing Law (Wis. Stat. §106.50).
- Landlords must provide reasonable accommodation in no-pet housing when valid registration or documentation is provided.
Travel Rights
- Airlines: Only trained and registered psychiatric service dogs are recognized under DOT rules.
- ESAs are treated as pets for flights.
- Public transit:
- Service dogs always allowed
- ESAs/PSAs may be accepted if calm, leashed, and documented
Veterinary & Animal Welfare Standards
Vaccination Schedules
- Rabies vaccination required for all dogs ≥5 months old (§95.21).
- Proof must be shown to animal control or during licensing.
- Recommended vaccines: DHPP (distemper, parvo, adenovirus, parainfluenza).
Neutering/Spaying Regulations
- Not required statewide.
- Most shelters must sterilize dogs prior to adoption.
Animal Welfare Acts
Under Wisconsin Statutes §951, dog owners must:
- Provide sufficient food, water, shelter
- Offer necessary veterinary care
- Protect animals from extreme temperatures
- Avoid confinement in unsafe environments
Cruelty violations may be misdemeanors or felonies.
